Terms of Use
These terms are an agreement between you and SmartBird Solution ("we", "us") for the YourBankDeals mobile app and website (the "Service"). By creating an account or using the Service you agree to them.
1. Beta software
The Service is currently in a testing phase distributed through Apple TestFlight. It may contain bugs, change without notice, or be unavailable. Beta builds expire and may need to be reinstalled. We appreciate your feedback and may use it to improve the Service.
2. What the Service does and does not do
- The Service shows a compiled list of card-linked merchant offers and lets you keep track of the ones you care about.
- The Service never connects to your bank, never asks for bank credentials, and cannot activate an offer for you. Activation always happens in your bank's own app or website.
- Offers are compiled from public information. Banks target offers to individual cardholders, so an offer shown in the Service may not be available on your account, and terms, amounts and expiry dates may differ from what your bank shows. Your bank's terms always control.
- Nothing in the Service is financial, legal, or tax advice.
3. Your account
You must be at least 18 to use the Service. Keep your password confidential; you are responsible for activity under your account. You may delete your account at any time from the Settings tab.
4. Acceptable use
Do not misuse the Service. In particular, do not attempt to access other users' data, scrape or bulk-export the offer catalog, submit false or abusive problem reports, interfere with the Service's operation, or reverse-engineer it except where the law allows. We may suspend accounts that break these rules.
5. Intellectual property
The Service, its design and its software are ours or our licensors'. Bank and card names and logos belong to their respective owners and are used only to identify the card an offer relates to. YourBankDeals is not affiliated with, sponsored by, or endorsed by any bank or card network.
6. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any offer will be available to you or that you will receive any reward.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of rewards, savings, profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim, which during the beta is zero.
8. Changes to the Service and these terms
We may change or discontinue the Service at any time. We may update these terms; if we do, we will change the effective date above and, for significant changes, notify you in the app. Continuing to use the Service after a change means you accept the new terms.
9. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in King County, Washington, unless applicable consumer law gives you the right to bring a claim where you live.
